Family and Medical Leave Act (FMLA) Protected Leave Now Available To Same-Sex Spouses

The National Law Forum

DrinkerBiddle

United States Secretary of Labor, Thomas Perez, recently issued an internal memorandum to department staff outlining the Department of Labor’s plan to issue guidance documents which will, among other things,  make protected leave available to same-sex couples under Family and Medical Leave Act (“FMLA”).  This action comes as the Department prepares to implement the Supreme Court’s recent decision in U.S. v. Windsor, which struck down the provisions of the Defense of Marriage Act (“DOMA”) that denied federal benefits to legally married same-sex spouses.  Calling it a “historic step toward equality for all American families,” Secretary Perez noted that the Department of Labor will coordinate with other federal agencies to make these changes “as swiftly and smoothly as possible.”

Secretary Perez stated that guidance documents would be updated to remove references to DOMA and to “affirm the availability of spousal leave based on same-sex marriages under the FMLA

Causes and Symptoms of Whiplash – Rockville Chiropractors

rockvillecaraccident

What is Whiplash?

In many injuries acquired from car accidents, whiplash is the most common. Whiplash is the result of rear end or side impact collisions. Soft tissues of the bone and spinal cord in the neck and back are injured during whiplash. Other words for whiplash include acceleration flexion-extension neck injury and soft tissue cervical hyperextension injury. Other medical terms for whiplash include cervical sprain, cervical strain, or hyperextension injury.

It occurs when a traumatic event causes the head to “whip” suddenly in one direction and then recoil in the other direction. Commonly, it happens when a car is hit or struck behind by another car. However, it can also take place when a car stops abruptly after striking a pole, a wall, or another car, and can also occur after a side impact.

In some cases, damage to the spine or spinal cord sometimes occurs from a…

Trademark, What is Trademark – Law – Trademarks

Raw Business Law

law_scale_background.jpg

A trademark provides protection to the owner of the mark by ensuring the exclusive right to use it to identify goods or services, or to authorize another to use it in return for payment. The period of protection varies, but a trademark can be renewed indefinitely on payment of corresponding fees. Trademark protection is enforced by the courts, which in most systems have the authority to block trademark infringement.

In a larger sense, trademarks promote initiative and enterprise worldwide by rewarding the owners of trademarks with recognition and financial profit. Trademark protection also hinders the efforts of unfair competitors, such as counterfeiters, to use similar distinctive signs to market inferior or different products or services. The system enables people with skill and enterprise to produce and market goods and services in the fairest possible conditions, thereby facilitating international trade.

Exclusive Right – Registered trade mark owners are conferred exclusive right…

Less divorce for larger families says study

dstevenshow2divorce

The constant squabbling within a family of five or six other siblings might be a distant memory but it appears that growing up in larger families means your are less likely to divorce later in life.

Image

They’re the findings of a study by the University of Ohio that has discovered the more siblings you grow up with the less likely they are to go through divorce. Of course America isn’t the UK and the study group of 60,000 showed that for every extra brother or sister the divorce rate fell by 2 per cent.

What it suggests is that bigger families promoted trust, openness, communication and other life skills which are essential in the up and down world of married life.

Here in the UK the number of marriages ending in divorce or legal separation is decreasing in line with smaller family sizes – the UK average is 1.8 children…

Vineland Go-Go Bar Loses Liquor License After Two Killed In Drunk Driving Accident

CBS Philly

VINELAND, NJ (CBS) – A Vineland go-go bar has had its liquor license revoked for serving alcohol to two underage men who were killed in a drunk driving crash after leaving.

Kashmir lost its liquor license two years after 18-year-old Jonathan Rothschild, of Clayton, and 20-year-old Ian Drebes, of Franklinville, were killed when Drebes lost control of his vehicle and crashed on Weymouth Avenue in Vineland around 2 a.m. on June 28, 2011.

Officials say the two consumed multiple alcoholic beverages earlier that night along with Rothschild’s girlfriend, Mandy Caudill. She said that around midnight, the two men argued in the parking lot of Taylor’s Grill and Bar in Wililamstown before parting ways and agreeing to meet up at Kashmir later.

According to officials, Rothschild and Drebes eventually went to Kashmir, where the bouncer checked Drebes’ ID, which was fake, but did not check Caudill or Rothchild’s. Caudill says the…

SALT LAKE CITY – A day after the Salt Lake County District Attorney ruled the fatal shooting of Danielle Willard by two West Valley City police detectives was not justified, legal experts weighed in on the decision.

Danielle Willard was shot and killed last November at the Lexington Park Apartments, 2200 West 3700 South, in West Valley City.

Defense attorney Brett Tolman said it’s both significant and rare when forensic evidence doesn’t back up a police officer’s story, but that’s exactly what the DA determined in the case. The two WVC PD detectives said they feared for their lives when Willard tried to leave the parking lot.

“What we don’t typically see, the officer’s statements not being corroborated and from what it appears in the investigation, you have some very significant differences in terms of the trajectory of the bullet, the angles with which the shooting…

What You Need To Know About Hit And Run Accidents

Law Wire News

Accidents involving motor vehicles are tough enough to deal with as it is. In an instant, you find yourself in a position where you’ve been hurt, a loved one has been hurt, or where your car, truck, or motorcycle has been damaged. You could be a pedestrian or bicyclist, too, who was at the wrong place at the wrong time. When a driver flees the scene of an accident or fails to provide driver documentation, it’s called a hit and run accident. While it’s against the law to leave the scene of an accident, according to the National Highway Traffic Safety Administration, over 700,000 of these accidents occur every year. That’s 11 percent of all auto accidents nationwide.

Understanding why another driver would flee the scene of an accident can be confusing. They might not have insurance, be driving intoxicated, not have a valid driver’s license, or even…
